At the end of 2005, E-Law became part of the greater student union Magister JFT. As a result, the chamber for Law & Technology was created, still holding on to E-Law's original principles. Now, E-Law points its angles to the areas of biotechnology, e-commerce and the internet, information- and communication technology (ICT), intellectual property (IP), media and information law, privacy and telecommunications law. These are not your everyday subjects, but subjects which every law student will encounter nonetheless. Private law often involves contracts concerning internet and criminal law entails for an important part computer crime and DNA. Through the year, several activities have been organised which touch upon these subjects, for example lectures, company visits and workshops.

Organized outings this year: reading on identity fraud - visit to law firm Bird & Bird - visit CCTV - visit to BOIP - international evening - visit to EC Bruxelles - 3 day visit to CERN Geneva - party.

    Domeinnamen nemen een steeds belangrijkere plaats in binnen de Nederlandse samenleving, er zijn reeds meer dan 3,8 miljoen .nl domeinnamen geregistreerd. Dit betrekkelijk nieuw fenomeen behoeft regulering, maar tot op heden is er nog geen sprake van “domeinnaamrecht”. In plaats daarvan heeft de Nederlandse instantie die belast is met uitgifte van domeinnamen, de SIDN, een geschillenregeling in het leven geroepen om enige specifieke rechtsbescherming te bieden wanneer een domeinnaam inbreuk maakt op een merk- of handelsnaamrecht van een ander. Ook via een civiele procedure kan een houder van een merk of van een handelsnaam ageren tegen onrechtmatig gebruik van een domeinnaam. Deze scriptie beoogt de geschillenregeling van SIDN zoals deze geldt sinds 2008 toe te lichten en te vergelijken met de reguliere gang naar de rechter.

    De parodie wordt gebruikt om mee te spotten of om misstanden in de samenleving op een luchtige manier doeltreffend aan de kaak te stellen. Het succes van een parodie is groter naarmate het originele werk bekender is. Om te zorgen dat de parodie herkenbaar is, is het noodzakelijk elementen van het originele werk over te nemen en eigen elementen toe te voegen.
    Deze inbreuk op het auteursrecht van demaker wordt gerechtvaardigd idien de parodie binnen de exceptie van artikel 18b Auteurswet (hierna: Aw) valt.

    Bekende merken hebben meer bescherming nodig. Hun reputatie is kwetsbaar en kan op verschillende manieren worden aangetast. Een bekend merk heeft daarmee meer te vrezen van de markt van een merk dat niet bekend is.

    Bekende merken kunnen aanspraak maken op een ruimere beschermingsomvang dan andere merken. Het merk is niet enkel beschermd tegen gebruik van een gelijk of overeenstemmend teken voor soortgelijke waren of diensten maar ook tegen gebruik voor niet-soortgelijke waren of diensten. Om ruimere bescherming van artikel 9 lid 1 sub c GMVo te kunnen effectueren moet het inbreukmakende teken overeenstemmen met het merk, worden gebruikt voor welke waren en diensten dan ook en er moet sprake
    zijn van aantasting van het bekende merk.

    Techniek is in het domein van het intellectueel eigendomsrecht traditioneel het object van bescherming in het octrooirecht. In het merken- en modellenrecht zijn zogenoemde techniekrestricties opgenomen. De techniekrestrictie beperkt de mogelijkheid om technische toepassingen te beschermen op grond van het merken- en modellenrecht. De techniekrestrictie bakent daarmee de grenzen af tussen het octrooirecht en het merken- en modellenrecht. Hoe ruim bescherming voor techniek via andere gebieden dan het octrooirecht is, hangt af van de wijze van uitleg van die techniekrestrictie.
